As of February 27, 2015 the Canadian Plant Growers Rights now complies with the 1991 UPOV Convention. This amendement contributes to an environment that attracts investment both domestically and internationally, as these expanded rights increase the confidence to invest. The changes also improve the varieties and provide more choices for farmers and create more suitable products for the end users.
The New Obligations under the Plant Breeders Rights 91 (PBR 91) are:
- Stocking and/or conditioning seed acquired without the authority of the breeder is an infringement of PBR 91
- As a Farmer it is important that you know the varieties you are purchasing. You should always obtain your Blue certified seed tag at the time of purchase.

Farmer “A” purchases certified seed of a PBR-protected variety and saves,stores and conditions some of the harvested material to use as seed on the farm in subsequent years. Is this allowed?
- The answer is: YES
Farmer”A” purchases certified seed, saves and stores some of the harvested material to use as seed on the farm next year, but gives some of it to a Farmer “B” to use as seed in exchange for other products or services. Is this allowed?
- The answer is: NO
Farmer A purchases certified seed of a PBR-protected variety, saves and stores some of the harvested material to use as seed on the farm in subsequent years. The farmer takes the farm-saved seed to a commercial cleaner, but doesn’t take it all back to use on the farm, leaving some with the cleaner in exchange for services. Is this allowed?
- The answer is: NO
Farmer “B” acquires farm-saved seed of a PBR-protected variety from Farmer”A” in exchange for a good or a service and takes it to a cleaner/conditioner to get it ready to use as seed ina subsequent year. Is this allowed?
- The answer is: NO
Farmer “B” acquires farm-saved seed of a PBR-protected variety from Farmer “A” and sells the grain produced from that seed. Is that allowed?
- The answer is: NO
Farmer “A” buys grain produced from seed of a protected variety from a grain buyer (elevator company, feed mill, feed lot etc.) and uses it as seed on his/her farm. Is that allowed?
